Within 5 Years vs. Outside 5 Years

The date of your prior conviction matters. A second DUI within 5 years usually carries mandatory jail time and a much longer license revocation than a second DUI outside that 5-year window.

  • Within 5 years: mandatory 10 days jail (up to 9 months total) and a 5-year revocation.
  • Outside 5 years: no 10 days minimum, but up to 9-12 months jail can still apply depending on facts.

Ignition Interlock
